Alina Habba has resigned as the chief federal prosecutor in the state. This comes after a judicial decision that questioned her eligibility to serve.
Acceptance of Resignation
The head of the Justice Department, Pam Bondi, confirmed her stepping down on Monday. She commented that the court's "flawed" ruling made it "untenable" for her to lead the department effectively.
"Do not interpret adherence to the ruling as defeat," she wrote. "This battle will now stretch across the country."
Court Ruling
The departure was triggered by a judicial panel ruled that she had been serving in violation of the law as the federal prosecutor. This ruling is could influence scores of prosecutions in the state.
The court declared that a temporary posting that bypassed Senate approval violated the statute on vacant positions.
Future Role and Reaction
The Attorney General added that Habba will stay on at the DOJ as a senior adviser. Habba plans to pursue additional appeals of the disqualification, aiming for a overturned decision.
Writing online, she argued that the judiciary "cannot be permitted to countermand the President's choice of attorneys entrusted with performing the primary duty of the administration of enforcing the law."

Bondi praised her tenure and pointed out that under her leadership, the city of Newark saw a significant drop in crime. She also stated that the city of Camden had its initial homicide-free summer since 1974 with no murders.

Habba, originally became part of Trump's personal legal team in 2021. She later acted for the former president in his business records case in New York last year, which resulted in his guilty verdict on dozens of charges of document fraud.
