Federal Judge Orders Release of Abrego Garcia from ICE Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in federal detention.
In her decision, the judge noted that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
